1. Acceptance of Terms

By accessing and using Darkcoal ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Darkcoal is an AI-powered character creation and storytelling platform that allows users to:

  • Create and interact with AI characters
  • Generate stories and interactive adventures
  • Use AI-powered image generation and text-to-speech
  • Participate in social feeds and group chats

3. User Accounts and Authentication

To use Darkcoal, you must create an account using magic link authentication. By creating an account, you agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

4. Privacy and Data

Your privacy is important to us. Key points about data handling:

  • Local Storage: Your characters, stories, and chat data are stored locally in your browser
  • API Keys: Your API keys are sent securely with requests and never stored on our servers
  • Usage Tracking: We only track usage counts for Coal balance management
  • No Content Monitoring: We do not read, analyze, or store your generated content

5. Pricing, Virtual Currency, and Payments

Virtual Currency ("Coals")

"Coals" are a limited, non-transferable, revocable license to use digital features within the Service. Coals have no monetary value, cannot be exchanged for cash, and are not refundable except as required by law.

Payment Processor

All payments are processed by Xendit. Xendit handles payment collection, fraud detection, and receipts. Darkcoal does not store your payment details.

Pricing Tiers

  • Free Tier: 100,000 Coals (one-time).
  • Coal Packs (One-Time): $1 (1M Coals), $5 (6M Coals), $9.99 (13M Coals).
  • Mega Pack ($12.99): 16,000,000 Coals — one-time purchase, no renewal.

Billing & Cancellation

  • Subscriptions update automatically unless canceled at least 24 hours before the period ends.
  • You may cancel anytime via the in-app settings or payment portal.
  • No refunds are provided for partial subscription periods or unused Coals, except where required by law.

6. Usage Limitations and Prohibited Content

You strictly agree not to use the Service to generate, upload, or share:

  • Child Sexual Abuse Material (CSAM): Any content depicting sexual abuse of children. We report all such content to NCMEC and law enforcement.
  • Non-Consensual Sexual Content: Deepfakes, revenge porn, or any sexual content depicting non-consenting individuals.
  • Real Person Depictions: Sexual or defamatory content depicting real people, including celebrities and public figures.
  • Violence and Gore: Realistic depictions of extreme violence, torture, or self-harm.
  • Hate Speech: Content that promotes violence or hatred against individuals or groups based on race, religion, gender, or orientation.
  • Illegal Acts: Content promoting illegal acts, including drug trafficking, human trafficking, or terrorism.

Violation of these terms will result in immediate account termination without refund and may be reported to authorities.

7. Content and Intellectual Property

You retain ownership of content you create using Darkcoal. However, you acknowledge that:

  • AI-generated content may not be subject to copyright protection
  • You are responsible for ensuring your content doesn't infringe others' rights
  • We reserve the right to remove content that violates these terms

8. Service Availability and Modifications

We strive to maintain high service availability but cannot guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the service with reasonable notice to users.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DARKCOAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify users of significant changes via email or through the service. Continued use after changes constitutes acceptance of the updated terms.
